Iowa Collector Charged for Allegedly Obscene Manga

Heres the story from Anime News Network.

The Comic Book Legal Defense Fund (CBLDF) has announced on Thursday that it is serving as a special consultant to the defense of Christopher Handley, an Iowa collector charged with the alleged possession of obscene manga. Handley faces up to 20 years in prison. Handley had received a package of seven manga that the Postal Inspector intercepted and determined to contain objectionable images. With a search warrant, the agents from the Postal Inspector's office, Immigration and Customs Enforcement Agency, Special Agents from the Iowa Division of Criminal Investigation, and officers from the Glenwood Police Department followed Handley home from the post office and seized his collection of over 1,200 manga volumes; hundreds of DVDs, VHS tapes, and laser discs; seven computers; and other materials. However, Handley is being charged for only part of his collection.

CBLDF's United Defense Group team, led by Eric Chase, has successfully petitioned District Judge Gritzner to drop some of Handley's charges and rule parts of a controversial law unconstitutional. Handley was initially charged under the United States Code, which was amended by section 504 of the PROTECT Act to prohibit distribution or possession of "a visual depiction of any kind, including a drawing, cartoon, sculpture, or painting," that —


• ‘(1)(A) depicts a minor engaging in sexually explicit conduct; and
• ’(B) is obscene; or

• '(2)(A) depicts an image that is, or appears to be, of a minor engaging in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex; and

• '(B) lacks serious literary, artistic, political, or scientific value;

Gritzner ruled that the last two clauses were unconstitutional as they restricted protected speech. Handley still faces charges under the obscenity clause, if the court determines that the material meets the Supreme Court's Miller Test. The Miller Test dictates that material is only obscene if a jury determines that it meets all of the following three criteria:


whether the average person, applying contemporary community standards would find that the work, taken as a whole, appeals to the prurient interest
whether the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law
whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value
CBLDF Executive Director Charles Brownstein notes, "In the past, CBLDF has had to defend the First Amendment rights of retailers and artists, but never before have we experienced the Federal Government attempting to strip a citizen of his freedom because he owned comic books."

Update: In July, the United States District Court for the Southern District of Iowa posted the ruling that struck down some of charges against Handley. Handley was originally charged on May 8, 2007. Thanks, hikaru004.

Update 2: According to CBLDF Executive Director Charles Brownstein, the start of this case has now been pushed back to February 2, 2009. Thank you Carl Horn for this information. Eric Chase, the lead defense lawyer on the case, provided a few more details about the manga in question in November, while award-winning comic book writer and Princess Mononoke adapter Neil Gaiman voiced his support for the defense.



It's not real. Why are we wasting tax payers money on this. What person A thinks is Obscene and person B can be two different things.

I just hope this case gets thrown out of the court.

I don't want my goverment telling me I can own a manga or anime just because they don't like it.

Dallas Cowboys are now 8-4.

I think Cowboys can beat Pittsburgh Steelers this week. If they do beat Pittsburgh, Dallas well have a good shot at making the playoffs.

Let's just hope Adam Jones doesn’t get into more trouble this year. Dallas is going to need another good CB to go with Newman in their secondary.

June 12, 2008 - It's time to say the thing that Japanophiles and otaku aren't supposed to say: I am bored to tears with manga and anime here in the US of A.

After one of our contributors posted about the apparent decline of TokyoPop earlier this month, it got me thinking more and more about my increasingly dismissive attitude towards what was previously one of my more passionate hobbies.

For any anime/manga aficionado whose paying even a small amount of attention, it is obvious that TokyoPop isn't the only one struggling. Geneon has been essentially dissolved. ADV has been oddly silent of late which could be good or bad, but judging how some of their fellow competitors are faring, chances are it's the latter. In fact, the only two publishers seem to have found some stability and success: Viz, with their massively popular shojo/shonen titles, and Funimation, with the never-ending Dragon Ball Z and One Piece franchises alongside some quality live-action movies.

While it is all fair and good to try and piece together what's happening within the manga and anime trade by reading between the lines of press releases and rumor mongering, it still seems somewhat disconnected from what made manga and anime flourish here in the states in the first place: The fans.

As Ramsey stated in his article, the current state of the economy, the cost of books and DVDs, file-sharing, the "gray" legal area that fan-subs fall into, etc… all of these things have had an impact on sales. Yet the problem is a little bit more complex than unfortunate fans with empty pockets and questionable legality issues.

From a collector's standpoint (that collector being "moi"), there's a slight stink of "get rich quick" scheming that has sullied the US manga/anime market. The over-saturation of mediocre product for the sake of having full bookstore shelves is one of the more obvious problems. For every Death Note that is imported and translated for English audiences, there are ten other titles that, for lack of a better phrase, are complete and utter crap.

Various distribution companies, having caught on to the fact that girls were spending their hard-earned dollars on shojo titles, instantly bombarded stores with pile after pile of any and all romantically-inclined manga in the hopes of cashing in on the craze. Companies that should have never attempted to delve into the unfamiliar waters of shojo comics (Harlequin Romance's release, in conjunction with Dark Horse Comics, of the Harlequin Pink line) tried to get their greedy hands on a piece of the action.

This demonstration of blatant disregard for the taste and intelligence of their targeted readership is, at its best, foolish, and at its worse, insulting.

The problem doesn't just begin and end with "girl" manga/anime either. Many of the themes found in various manga, whether shojo, shonen, comedy or others, come off as stale and unimaginative. Fans have been inundated with the same plot lines, same dialogue, same character backgrounds and same art style. While the argument of "if it ain't broke, don't fix it," can be made, the counter notion of, "too much, too soon," also holds a certain amount of relevance.

Another slightly questionable and very controversial practice from the hard-core fan POV has been TokyoPop's aggressive push of OEL (Original English Language) manga. While the argument over whether or not OEL manga is or is not "legitimate" manga can be argued back and forth forever as a personal taste issue, things get a little more sticky when one references the 2005 article by Publisher Weekly. In the article, Viz publicity director, Evelyn Dubocq is quoted as suggesting that companies are only pushing original authors because, "they are struggling to find licensed content. Manga are Japanese in origin." Her statement is backed up when, in the same article, James Killen (a graphic novels buyer for Barnes & Noble) states that the Japanese licensed titles outsell the OEL titles. While TokyoPop rallied back with some very strong points in favor of OELs, given TokyoPop's current press release and supposed state of affairs it looks as if Viz may have sunk 'Pop's battleship in this debate.

With the constant and ever increasing influx of manga and anime, a certain mystique has long been missing from "the hobby." No more are the days when anime and manga had to be special ordered from some independent Asian imports shop. No more trolling through the basements of various neighborhoods comic stores for that old VHS of Ranma ½. Similar to the current videogame market, the argument that in exchange for ease of acquirement and inclusion of both "hardcore" and "casual" fans, companies are shooting for the lowest common denominator: A "jack of all trades but master of none" attitude where everyone gets a little bit of something, but none of it is very good.

Before the Wachowski brothers pillaged Speed Racer. Before Adult Swim broadcast decently English-dubbed animes featuring short blonde boys who know alchemy. Even before Ghost in the Shell was released on the big screen to select art-house audiences. Hell, before I was even in college, you knew the manga you were reading or the anime you were buying was assured to be of high quality. The shows or books would be in-depth and pushing the boundaries of anything you had ever seen before because if the companies in Japan felt that the title was worthy enough to sub-title and release it in the States then there must be something there.

Now, with most Western publishing companies pushing every license they can get their hands on, companies that shouldn't be in the game are attempting to stick their foot in the door for no good reason whatsoever. Other companies are trying to fill a void or establish new "genres" of manga/anime in order to keep milking their cash-cow. Simply put, US buyers and fans have become overwhelmed with a watered-down product.

As terrible as this may sound, I'm a little glad to see some of these companies shrinking their numbers and cutting back on production. I'd like to see the manga/anime/otaku lifestyle come full circle and resemble its former golden glory days once more.

You should read this article on what John McCain need's to do between now and November 4.

This is from Lisa Schiffren of National review online Quote " At this point, the McCain campaign’s goal should be to raise doubts about Obama’s trustworthiness, and thus ability to lead. This will require a strategy and a tactic.

The campaign’s strategy should be to attack from all directions: character, past associations, political practice in Chicago, “present” votes, lack of a record of accomplishment. It should question what it means for a law professor to leave no academic paper trail, yet produce two well-written autobiographies.

Tactically, it should have Sarah Palin and surrogates — Giuliani, Gingrich, Romney, Pawlenty, Crist, and Sanford — blast away from a few different angles a day. Have the articulate ones make complete, coherent cases on each issue.

Make Barack Obama defend himself, fill in the mysterious gaps, and list concrete outcomes from his work. We shall see how much grace he brings to that situation. Attack hard enough to make the American people pay attention. Any wavering voter should know the reasons that a vote for Obama is a risk, and they should know what it guarantees.

McCain must rise to this moment and be crystal clear about his future economic policy. And it has to be good. Let people know he understand the pain we are all facing together. Because making voters wary of Obama, which they have resisted pretty strenuously heretofore, doesn’t get them to the polls for the Republican candidate.

Here are ten suggestions for the campaign:

1: The economy. Democrats are blaming the current crisis — the one requiring the now-$800 billion bailout — on McCain’s aversion to regulation. Explain the difference between more regulations and useful regulations. Explain that all the regulations in the world, applied to financial institutions, won’t help if government policy mandates that banks issue mortgages to people who can’t repay them. Explain who wanted so badly to expand homeownership, and why, and who benefitted from the work of Freddie and Fannie. List the top three recipients of Freddie and Fannie’s campaign donations.


That’s the history. Here is the abstract point to move to: Obama and his allies truly, deeply believe that markets are bad, and a small group of smart, good-hearted people — them — should be running things. The smart people had the good intentions of having the poor own homes. So they overrode traditional banking norms, which they called racist. Now we are all paying for their leftist ideology. For a real fight, mention the Community Reinvestment Act. Ask what happens in the near future when the “A team” — Nancy Pelosi, Harry Reid, Charles Rangel, Barney Frank, and Barack Obama — are in charge of the economy, during the coming recession.

Don’t sugar-coat the economic situation. If McCain wins, he presides over tough times.

2: Taxes. Contrast McCain’s tax policies with Obama’s by explaining the difference between letting people (and businesses) keep their own money, and giving them benefits at taxpayer expense. The former is what it means to have economic freedom. The latter is a real cost to taxpayers. McCain would not “spend” $300 million dollars, as Obama alleges, by failing to confiscate $300 million from businesses or individuals.

Also explain that Barack Obama’s tax ”cuts” for the poor consist of straightforward, massive redistribution of taxpayer dollars to people who already are not required to pay taxes. Hammer the point that only about 60 percent of American earners even pay taxes. Taxes for the working poor are called the Earned Income Tax Credit, which is the opposite of a tax. Cite statistics indicating that decided “tax recipients” are pro-Obama, support higher taxes for those who pay, and want bigger checks.

Ask why Barack Obama wants to make us all wards of the state, with state health care. Is this a good moment to embrace 20th Century Socialism Lite, even if we are facing a year or two of belt tightening? Shouldn’t the future be freer, with less state interference in our lives? And on the matter of the recession we are facing — explain in language a 10-year-old can understand that we will get through it faster if we don’t gum up the job-creating process with new taxes.

3: Spending. McCain should say he will cut spending because he believes that government should be smaller for both practical and philosophical reasons. Enough about earmarks. They are bad. But Obama won when he said they were only $18 billion — a small percentage of federal expenditures. Point out that the “bridge to nowhere” was egregious — but even with more legitimate projects, choices have to be made. Note that when Jim Lehrer asked what new programs each candidate would be willing to cut, Obama offered none but said we should be investing more money in early-childhood education. Here’s a phrase: magic thinking. We’re broke. Ask voters if they personally are focused on cutting spending or buying better services right now, going into this recession.

On Tuesday night, have McCain look at Obama and say, “You think early-childhood education is important? That $972 million you spent on local nonsense, money that went to Tony Rezko, programs administered by your Reverend Wright, and, by the way, the hospital where your wife works, could have paid for a fair bit of it.”

4: A little populism. McCain will have to defend much of the bailout by explaining that Wall Street and Main Street are two sides of the same coin. Of course McCain is not a fan of massive CEO salaries, though he doesn’t think it is the president’s job to level them. Admonish that this is the time for executives to tone down the greed and boards to makes sure they do.

5: Run McCain as his own man, not as a senator. McCain should stop saying “maverick,” and stop being sentimental about the Senate and his place in it. Most voters despise Congress. Stop with the “my dear friend” and “I love him, but . . .” What does he think an insider sounds like?

6: Bill Ayers and other close friends. Discuss the details of domestic terrorist Bill Ayers’ long-term relationship with Obama. Ayers served with the candidate on the Woods Fund board, and Obama was handsomely paid for that work. Who introduced them, and when? Make Obama explain why the Woods Fund gave grants to racial programs (“Juneteenth education”) rather than basic education for deprived minority kids.

Speaking of terrorist buds, Barack and Michelle were close with Rashid and Mona Khalidi, convicted terrorism supporters. What was that about? Make the analogy to the Reverend Wright. Hit the larger point that there are so many of these long-term social relationships with people who hate this country and find it mean-spirited and racist. What does Barack enjoy about hanging with these types?

7: Arrogance bordering on treason. On his listening tour last summer, Senator Obama attempted to undermine Bush administration policy in Iraq. In personal conversations he asked that the Iraqi leadership wait for the next administration (his) to begin serious troop withdrawals — as Amir Taheri has documented. Apparently, he wanted to make it look as if the troops were coming home due to him.

8: Women. Why are women on Obama’s Senate staff in lower positions, and making less money, relative to the McCain campaign’s women? McCain is a feminist now, what with his VP choice.

9: Smart but wrong. McCain has a relatively inexperienced running mate. She’ll be a swell veep, but she isn’t really ready to be president right now. When it comes up, note that judgment matters. Your ticket can boast of no Harvard degrees. But experience teaches that people who are smart and wrong are far more dangerous than people who have solid instincts and less grad school. But by far the worst combination is an inexperienced intellectual who has absolute conviction that his radical ideas are superior.

10: What he’s for. While leveling attacks, McCain should simultaneously convey real empathy for Americans who are in tough economic situations. He can share tales of suffering, show that his heart goes out to his fellow citizens, and promise to do his utmost to help. But it is not possible for the federal government to fix everyone’s problems. Discuss health care, business formation, jobs. Announce that McCain will assemble a new team, and name a few reassuring leaders. Offer a comprehensive economic plan to firm up the economy, shrink government, foster job creation, and make sure that safety nets are in place. In other words, a plan to tweak, not reinvent, the economy. End quote"

Dallas Cowboys outlast Eagles 41-37.

I love the way the Dallas Cowboys scored tonight. What I didn't like is the Dallas D and the mistakes has far has turnovers and yellow flags calls on Dallas in the game. They can't do that again and expect to come out on top too often.

Another thing I have to say is that DeSean Jackson needs to learn not to hot dog it before he scores.

Still to have that many turnovers and to still score 41 is really something.

All in all it was good win for Dallas. Now time to play VS Green Bay next week.

Dallas Cowboys pass and run over Browns in week one.

The one problem Dallas had in this game was to many yellow flags call on them by the refs and Tony Romo throwing a pick in the end zone in the 4 QTR. They still won 28-10 over the Browns. Now time of the Cowboys to host the Eagles next week on Monday night.

I hope Dallas can keep winning like it did last year in the regular season. I also hope Tony Romo doesn’t turn into a one year wonder.

The D looks really good, but the o might have some problems. They needed to get a NFL veteran at WR to go with TO and they didn't. I hope that also doesn't bite them this seasons. I think for their season to be look at has a good one I think Dallas well have to get to the Superbowl.

I talk about why you should buy Patlabor 2: the movie.

Has far has the movies go Patlabor 2 the movie is the best of what Patlabor has to offer. I love the deep Political and social stuff in it. The song Unnatural City by Kenji Kawai ready kicks butt. Just the parts alone when Shinobu Nagumo and Yukihito Tsuge are talking to each other makes it a movie worth watching.

I know it came out in 1993, but the visuals are so good that you want to watch till the end.

It's also nice to see a Political anime that doesn’t have the United States has the main bad guy. It's hard to fines those animes now and days.

The first Patlabor movie was ok and third movie was a joke.

I hope people go out their and buy this movie.

This is a trailer for Watchmen.



I watched this Watchmen trailer before Batman the Dark Knight movie. This movie trailer of Watchmen look really good. I hope the movie turns out to be really good as will. I have read all of the Watchmen Comics about a month ago and now I'm a big fan of Watchmen.

One of my younger brothers did really care for the story that much. I don't why he thinks this is going to destroy comic book movies has we know it. It's a great work of art on it's own. It's also in the parallel universe in DC. So why do I care what happens in parallel universe in DC. I'm a big Marvel fan. DC will also be in number two in my book.

Also what else dose DC have after Batman and Superman. It's watchmen.

The tone and music for the trailer is a prefect 10 also.

P.S this movie better be rated R or I won't go see it.

Rock Band 2 song list revealed at X-box 360 press event at E3.



The only reason why posting about this is because of two songs that I will be singing the night away. Duran Duran Hungry like the Wolf and Bill Idol White Wedding. My going sing so much on my X-box 360 my younger brothers will go in my room and unplug my X-box 360. Now if they could add Bill Idol eyes without a face and Dancing with myself has download song later.

Dancing with myself is the unofficial song of the NCAA basketball tournament.

Another that going to bugs me is that most these games are coming out around December. I don’t if I can afford getting all these video games for myself and my family.

New Mega Man 9 game.



I can't wait to get my hands on this game. I hope this starts a new trend in old school games. I love to see a Castlevania 5 game with SNES graphics or The Guardian Legend 2 with NES graphics.

Put those type of games on XBLA marketplace or WiiWare and I be a happy camper.

Tatsunoko vs. Capcom: Cross Generation of Heroes trailer!



I wish this game was coming to the United Stats, but I don't think that's going to happen. I always want to play as G4 in a fighting game.

I hope this dose well in Japan so that way we can see more cross-over like this one. Maybe a Capon VS. Clamp. I wouldn't mind fighting has Chi or Sakura Kimonos. That would be sweet.

How about AIC VS. Capcom. I always wanted to play Tenchi, Ryoko or Belldandy. If they made that game I would import it and play it to death.

I would even take a Gonzo VS. Capcom fighting game at this point.

Final Fantasy IV Comparisons.

It's number 3 on my list (with X and VI being one and two on my list). I going to buy this game. Unless one of my younger brothers buys in first.

The Phoenix Suns pick Robin Lopez with the 15 pick and Malik Hairston with the 48 in the 2008 NBA draft. Update Suns trade 48 pick for Goran Dragic.



I don't mind pick so much. Their are teams like Indiana and Chicago that have allot points guards and they can trade to get one of those guards to play back up in Phoenix.

Metal Gear Solid Retrospective part 5.



This video they talk about all the cell phone and portal hand held games to Metal Gear Solid. I didn't care for the AC!D games at all. Didn't play cell phone games. I guess you had to live in Japan to play those games.

I did like the Portal Ops games allot. When you buy Portal Ops Plus you are getting a strip down version of MGS Portal OPS. Let's just say you can see why the game only cost between 20 and 15 dollars.

I hope they make more games that have big boss has the center piece. That would be cool. Next week their talking about the hole story line to Metal Gear Solid and how all the games tie together. I can't wait!

Metal Gear Solid Retrospective Part 4.



Metal Gear Solid 3: Snake Eater to me it's the best video game ever made. It has all the best things you want in Metal Gear Solid game, without having the confusing story lines from the pass games. I don't know if Metal Gear Solid 4 is going to top MGS 3 has far has story goes. Let’s hope so. Out of all the fights in MGS 3 the one with The End is my favorite. Those fight could last up to an half hour. Second favorite fight is with the Boss.

The only two things I didn't like about Snake Eater is the Fury and Colonel Volgin. Colonel Volgin becasues of the ball graping of males. The Fury for this reason. He looks just like FireBall from The Running Man.

Metal Gear Sold Portal ops was ok game. I didn't like the fact you don't get see Big Boss totally turning into a bad guy. I stared thinking to myself when dose that happen.

I going to so buy this DVD when it comes out on July 8 of this year. This trailer shows more of the six stories that in the movie. Unlike the first trailer.

The only downer that I don't like is that it's 75 minutes long. This movie needs to be in more 110 minute to 120 minute range.

Metal Gear Retrospective Part Three.



I really like playing Metal Gear Solid 2: Sons of Liberty. I don't why allot of people had a problem playing has Raiden. I like the fact that Hideo Kojima likes to take chances in his games and try something different. That’s why I love the Metal Gear Solid so much. I do have to say the cut scenes were a little on the long side though for Sons of Liberty.

I did like the extra story modes in Substance.

Metal Gear Solid Retrospective part two.



This one's about the Metal Gear Solid on the PS1. For me this one was the hardest Metal Gear game to beat on any of the 3-D Metal Gear Solid game's. That's why I love Twin Snakes video game that they put on gamecube. That remake of Metal Gear Solid made it allot easier to beat. Putting first person mode button when you were fight was so sweet. Having better looking game also help has well.

One thing I didn't like about this game is that their was no really hot women. Don't get me wrong Meryl and Sniper Wolf were cute and all, but their not like the women that were coming up in the games to follow. Fortune, EVA and The Boss anyone.

Wolverine and the X-Men.



This show is coming out first quarter 2009 on Nicktoons Network in the United States.

Can't wait for this show. I hope it like live up to the X-Men Cartoon that came on the Fox channel that came out in the early 1990's.

I hope they also don't have any of the stories lines from X-Men: Evolution show. That show was so bad. I mean come on the most the X-Men are in in high-school and Gambit, Colossus are bad guys.

Now all I need his a date for when the new Spawn Cartoon and I well be happy camper.

The Phoenix Suns are something else.

Again the Suns can't beat the Spurs. They let some many games in the first playoffs VS the Spurs slip though the figures. I hope the Suns can win a title next year. If they can't they are going to blow up the team and start all over.

I hope the New Orleans sweep the Spurs in four game's in the next round.

Space Invaders Extreme is coming out on the PSP Jun 17, 2008. I can’t wait to play this game. I can’t believe the first Space Invaders game came out 30 years ago! God I feel old.

To this day you can still find a Space Invaders arcade game at your local Laundromat.

It not looking good for the Suns. They had to win game two and they couldn't do it.

It doesn’t help that the Suns only score 11 points in the third quarter.

It also doesn’t help when the Suns would drive into the line and the Spurs players would foul them and refs wouldn't call the foul.

Goglo 13 TV show is finally here!!!!

From What I can tell it looks like a winner.

It's good to see an anime from Japan that I can be really hype for. It feel like 1981 and 2003 all over again. I can't for this show to hit the north American market.

This game need to get second life on XBLA.

Who wouldn't want to play has Dirk the Daring on XBLA. It also one of the few I can beat with remote control.

A review of Lupin the III: The Secret of Twilight Gemini.

This movie has all the regluar people you expect in lupin. The lupin the III master thieif. Jigen sharp shooter and lupin right hand man. Fujiko a women who would do anything for money. Goemon a master samurai. Also a part of lupin team. For course inspector zenigata here also. A man who has been chaseing lupin of years. Heck of almost 50 years.

This story start when a old enemy and he look like he's on his death bed. Give him half of the diamond of the twilight. Then he tells him that the other half of the diamond is in morocco and that he should go their and fine it and when he dose it opens a treasure of immeasurable value that is also in morocco. This of course is not going to be easy. He's ever step is being followed by Masked assassins,and a old enemy of Goemon whos part of the assassins. That happens even before he gets to morocco! When he gets their he's get's mix up with fighting factions who want control of morocco and don't belive in the old story's of the diamond of the twilight. To bad the other group of masked assassins do Belive it. To make matter worst zeigata is their also.

The thing I have to say about this anime is that it was made in 97. So it looks pretty good for the time it can out. Also their is realy good flash-back that shows what happens to the diamond and why it was spilt in half. That hole part is done in a movie style back in the 1920's. The hole movie has a feel of the north aftica and middle-east feel that we got in those old lawrence of Arabia movie's. Also fujiko is hot also in this one. She seem to be chaseing lupin, instead of it been the other way around. Warning, their is some nudity though. All in all it's 9 out of 10.
